E-sign and eDisclosure consent

How do we capture E-SIGN consent for electronic mortgage disclosures before anything is sent, with the date, the method and the demonstration of access on record?

Make consent the first step of the disclosure path, not a checkbox on the application. Before any disclosure goes electronically, Callvu shows the borrower the required statements (the right to paper, how to withdraw, the hardware and software requirements, the scope of the consent), obtains the consent in a way that demonstrates the borrower can access the documents in the form used, records the date, the method and the device, and gates every electronic delivery on that record. The problem today

The Loan Estimate was emailed on day two, and the consent to electronic delivery was signed on day five.

Today, without Callvu

The disclosure desk emails the Loan Estimate to meet the three-day deadline. The borrower's E-SIGN consent is somewhere in the application package, or will be signed at closing. Under the Act, a disclosure that must be in writing and was delivered electronically before consent is not delivered, which means the Loan Estimate was late, which means the file is a finding and possibly a cure.

E-SIGN's requirements are specific and testable: the statements the consumer must see before consenting, consent in a manner that reasonably demonstrates access to the electronic form, and records of the consent. The co-borrower needs their own. A withdrawal of consent changes the delivery method for everything after it.

The consent is one screen that takes a minute, if it is the first screen.

How it runs

From the requestto the system of record.

The application reaches the first point at which a disclosure will be delivered, or a borrower is added. Callvu opens the consent step for each borrower before any electronic delivery.

Borrower
Reads the statements and consents, or chooses paper, on their own device; each co-borrower does the same.
Callvu
Shows the statements, captures consent with the demonstration of access, records it, and gates every electronic delivery on it.
  1. Show the required statements

Each borrower sees, before consenting, the scope of the consent (which disclosures and records it covers), the right to a paper copy and any fee, the right to withdraw and how, how to update contact information, and the hardware and software requirements for access and retention.

  2. Classify the borrowers and the documents

Each borrower on the loan gets their own consent step, and the consent's scope is set from the disclosures the loan will produce (the Loan Estimate, the Closing Disclosure, servicing notices), so the borrower knows what they are consenting to receive electronically.

  3. Chase and verify the consent

The borrower consents in a way that demonstrates access in the form the lender will use (for example, by opening a test document in that format from the same device and confirming a code it shows). The consent, the date, the method, the device and the contact address are recorded. A borrower who does not consent is marked for paper delivery.

  4. Write back and gate

The consent record is written to the loan file in the LOS, and every electronic disclosure delivery for that borrower checks it first; a delivery without a current consent is blocked and sent on paper instead. A withdrawal of consent is captured the same way and switches the method from that moment.

Where it ends: Every borrower has a consent record with the statements shown, the demonstration of access, the date and the method, and no electronic disclosure went out before it. The Decision Trace shows the gate on each delivery; the Audit Trace shows the consent event and any withdrawal.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The first disclosure point in the application, on each borrower's own device.

The back office

The disclosure desk never has to ask whether consent exists; the delivery is gated on it.

The Decision Desk

  • A borrower who cannot complete the demonstration of access (an unsupported device) routes to the loan officer in the Decision Desk with the paper option, so the disclosure clock is still met.

Questions

What buyers ask next,answered plainly.

What does the borrower have to do?

Read the required statements and consent in a way that shows they can open the documents in the form the lender uses, on their own device. It takes a minute and is recorded.

What if the co-borrower never consents?

Their disclosures go on paper. The gate checks each borrower's consent separately.

What stops a disclosure going out before consent?

Every electronic delivery checks the consent record first; without one, the delivery is blocked and sent on paper.
