Hybrid and remote e-closing

How do we run a hybrid closing where the borrower e-signs the documents that allow it before the table and signs the rest in person, with the signed set returned and checked?

Split the package by what the law and the investor allow to be e-signed, and check both halves. Callvu classifies each closing document as e-signable or wet-signed under E-SIGN, the state's notarization rules and the investor's requirements, delivers the e-signable set to the borrower ahead of the table on a process-controlled screen with the E-SIGN consent on record, sends the wet-signed set to the settlement agent, receives both signed sets back, checks every signature and notarization, and assembles the complete executed package for funding and delivery.

The problem today

The borrower spent ninety minutes at the table signing documents they could have signed at home, and one page came back unsigned anyway.

Today, without Callvu

A traditional closing puts a hundred pages in front of the borrower at a table with a notary. A hybrid closing lets the borrower e-sign most of them in advance and sign only the note, the security instrument and the notarized affidavits in person. The split depends on E-SIGN, the state's notarization rules, the investor's e-note and e-vault requirements, and the lender's own policy.

The failure modes are the split being wrong (a document e-signed that needed a wet signature), the e-sign consent missing, and the returned sets not being checked page by page. Each is a document that must be re-executed or a loan that cannot be delivered.

The split is a classification, and the check is a reading. Both are process work.

How it runs

From the requestto the system of record.

The closing package is assembled and the closing date is set. Callvu classifies each document for the hybrid closing and opens the signing case.

Borrower
E-signs the advance set on a secure screen and signs the rest at the table.
Settlement agent
Conducts the table closing with the wet-signed set and returns it through the secure link.
Notary
Notarizes the documents that require it at the table (or by remote online notarization where allowed).
Closer
Sees both sets' status and resolves exceptions.
Callvu
Classifies, delivers both sets, captures e-signatures, receives and checks the returns, assembles the executed package.
  1. Classify the documents

Each document in the package is classified as e-signable (disclosures, affidavits not requiring notarization, lender forms) or wet-signed (the note where no e-note is used, the security instrument and riders, notarized affidavits, state-required wet documents), under E-SIGN, the state's rules, the investor's requirements and the lender's policy.

  2. Chase and verify the advance set

The e-signable set is delivered to the borrower ahead of the closing on a process-controlled screen, gated on the E-SIGN consent on record, with each document shown in full and signed with a timestamp; reminders run and the closer sees progress. The wet-signed set goes to the settlement agent through the secure link with the signing instructions.

  3. The table and the return

The borrower signs the wet set at the table with the notary; the settlement agent returns the signed set through the secure link; both sets are read page by page for every signature, initial and notarization block, and any defect is listed with the page.

  4. Write back

The complete executed package (the e-signed set with its audit trail and the wet-signed set as returned) is assembled, checked and written to the LOS, with defects routed to the closer for re-execution before funding.

Where it ends: The borrower signed what could be signed in advance on a secure screen and only the rest at the table, both sets were returned and checked page by page, and the executed package is complete in the LOS for funding and delivery. The Decision Trace shows the classification and each check; the Audit Trace shows the e-signatures, the return and the defects.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The borrower's secure screen for the advance set; the settlement agent's secure link for the wet set.

The back office

The closer sees both sets' status and resolves defects; funding receives a checked package.

The Decision Desk

  • A document whose classification is uncertain for the state or the investor, or a defect that cannot be cured before funding, goes to the closer in the Decision Desk with only the allowed outcomes.
