Policy replacement notice and acknowledgment

How do we deliver the replacement notice when a new life or annuity policy replaces an existing one, get it acknowledged by the applicant, and file it with the application on the state's rules?

Detect the replacement from the application and run the state's notice by rule. Callvu classifies the transaction as a replacement from the application's answers and the existing policy data (a policy surrendered, lapsed, borrowed against or reduced to fund the new one), selects the state's replacement notice and the comparison the regulation requires, delivers it to the applicant with the existing policy's details, captures the applicant's and the agent's signatures on the notice within the regulation's timing, sends the notice to the existing insurer where the rule requires, chases what is missing, and files the acknowledged notice with the application in the policy system with the dates the regulation measures. The problem today

The replacement question was answered no, the old policy was surrendered a week later, and the examiner found the pattern across the agent's book.

Today, without Callvu

Replacing a life or annuity policy is lawful and often right for the customer; it is also where the state regulators look hardest. An agent marks the application as not a replacement; the old policy is surrendered after the new one issues; the notice and the comparison that would have protected the customer were never delivered, and the insurer's replacement register does not show the transaction. The market conduct exam finds it.

The state replacement regulations (based on the NAIC Life Insurance and Annuities Replacement Model Regulation) define a replacement broadly, require the agent to present and the applicant to sign the notice regarding replacement at or before the application, require the insurer to notify the existing insurer within a set number of days and to keep a replacement register, and give the applicant a free look period that is longer for replacements. The detection has to come from the data, not the checkbox.

A replacement done by rule is a replacement that survives the exam.

How it runs

From the requestto the system of record.

A life or annuity application is taken (through the application process) that involves an existing policy. Callvu classifies the transaction on the answers and the policy data.

Applicant
Receives the notice and the comparison, and signs the acknowledgment on their phone.
Agent
Signs the notice, and completes the existing policy's details.
Existing insurer
Receives the replacement notice where the regulation requires it.
Compliance
Owns the replacement register and decides exceptions in the Decision Desk.
Callvu
Classifies, selects the state's notice, delivers, captures signatures, sends, chases and files.
  1. Classify the replacement

The application's replacement questions, the existing policies on the insurer's own books, and the financing of the new premium (a surrender, a loan, a withdrawal, a lapse, a reduction in coverage within the regulation's window) classify the transaction as a replacement or not, by the state's definition; an answer of no that conflicts with the data is flagged.

  2. Deliver the notice and the comparison

The state's replacement notice (the model's 'Important Notice: Replacement of Life Insurance or Annuities' or the state's version) is delivered to the applicant with the existing policy's details (the company, the policy number, the insured, whether it is to be replaced or financed) and the comparison or illustration the state requires; the applicant and the agent sign it within the regulation's timing (at or before the application is taken).

  3. Chase and verify, and send

A missing signature, an incomplete existing policy list or an unanswered item is chased from the agent or the applicant on the clock; the replacement notice is sent to the existing insurer within the regulation's period with the policy details, and the free look period for a replacement is applied to the new policy; an exception (a conflict between the answer and the data, a late signature, a pattern on the agent's book) goes to compliance in the Decision Desk with only the allowed outcomes.

  4. Write back

The acknowledged notice, the comparison, the dates (the notice signed, the notice sent to the existing insurer, the policy delivered, the free look end) and the classification are filed with the application in the policy system and entered in the replacement register, so the register and the file match.

Where it ends: Every replacement was detected from the data, noticed and acknowledged on the state's timing, sent to the existing insurer, and filed with the application and the register. The Decision Trace shows the classification and any compliance decision; the Audit Trace shows the delivery, the signatures and the sending with their times.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The applicant signs on their phone within the application; the agent completes and signs in the same record.

The back office

Compliance owns the register from the record and sees exceptions and patterns; nobody reconciles files to a register.

The Decision Desk

  • A conflict between the replacement answer and the data, a late signature or a pattern on an agent's book goes to compliance in the Decision Desk with the record and only the allowed outcomes.

Questions

What buyers ask next,answered plainly.

How is a replacement detected?

From the application's answers, the existing policies on the insurer's books and the financing of the new premium, against the state's definition; an answer of no that conflicts with the data is flagged.

When must the notice be signed?

At or before the application is taken, by the applicant and the agent, with the existing policies listed; the process captures it in the application flow.

What goes to the existing insurer?

The replacement notice with the policy details, within the state's period (five business days under the model), sent and recorded from the same record as the register.
