Intent to proceed

How do we capture the borrower's intent to proceed after the Loan Estimate, with the date recorded before any fee is collected?

Make intent to proceed a step the fee cannot skip. After the Loan Estimate is delivered, Callvu asks the borrower to state their intent to proceed on a secure screen, records the date, the method and the Loan Estimate it refers to, and gates every fee collection (other than a credit report fee) on that record, so no appraisal is ordered and no fee is charged before it. The problem today

The appraisal was ordered the day the Loan Estimate went out, and the intent to proceed is a note in the file.

Today, without Callvu

The loan officer, eager to move, orders the appraisal and collects the fee as soon as the Loan Estimate is sent. The borrower had not said they wanted to proceed, or said it on the phone with no record. Under TRID the lender may not impose a fee, other than a bona fide and reasonable credit report fee, until the consumer has received the Loan Estimate and indicated an intent to proceed. The appraisal fee is a violation and a refund.

Intent to proceed can be given in any way the lender allows, but it must come after the Loan Estimate is received, and the lender must document it. The record is the date, the method and which Loan Estimate the borrower saw.

It is a thirty-second step that protects the lender from a finding on every file.

How it runs

From the requestto the system of record.

The Loan Estimate is delivered and received (or deemed received). Callvu opens the intent-to-proceed step for the borrower and holds fee collection and the appraisal order.

Borrower
States their intent to proceed, or not, on a secure screen after receiving the Loan Estimate.
Loan officer
Sees whether intent has been given and cannot order the appraisal or collect a fee before it.
Callvu
Delivers the step after receipt, records the intent, gates fees and the appraisal order, and writes the record to the LOS.
  1. Chase and verify receipt

The step opens only after the Loan Estimate is received: the electronic delivery is acknowledged, or the mailbox rule's three business days have passed. The borrower is sent the link and reminded until they act or decline.

  2. Classify the Loan Estimate in force

The step references the Loan Estimate the borrower received, by date and version; where a revised Loan Estimate has since issued, the step references the latest one so the intent is given on the terms the borrower actually saw.

  3. Capture the intent

The borrower states their intent to proceed on a process-controlled screen that shows which Loan Estimate (date and version) it refers to; the date, the method and the device are recorded. A borrower who declines, or does not respond within the period the Loan Estimate's terms are available, is recorded as such.

  4. Write back and release

The intent record is written to the LOS, and the gates on fee collection (other than the credit report fee) and on the appraisal order are released. Any fee charged is checked against the record's date.

Where it ends: The borrower's intent to proceed is on the record with its date and the Loan Estimate it followed, and no fee or appraisal preceded it. The Decision Trace shows the receipt and the gate; the Audit Trace shows the intent event and the release.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

A link to the borrower after the Loan Estimate is received; a loan officer can present the same screen.

The back office

Processing and the appraisal desk see the gate released, not a note in the file.

The Decision Desk

  • There is no Decision Desk step: the intent is the borrower's. A borrower who does not respond is reminded, and the loan officer sees it.

Questions

What buyers ask next,answered plainly.

Can the loan officer order the appraisal first?

No. The appraisal order and fee collection are gated on the recorded intent to proceed, and the gate cannot be overridden.

What counts as intent?

The borrower's statement on a secure screen, after receiving the Loan Estimate, recorded with the date, the method and the Loan Estimate it refers to.

What if the Loan Estimate was mailed?

The step opens three business days after delivery under the mailbox rule, unless earlier receipt is evidenced.
