Early intervention outreach

How do we reach every delinquent borrower within the Regulation X timeframes, offer the loss mitigation options, and record the contact and the outcome?

Run early intervention as a clock on every delinquent loan. Callvu classifies each loan on the day it becomes delinquent (the delinquency day count, the investor, any exemption such as a bankruptcy or a cease-communication request, the borrower's contact preferences), makes the live contact attempts through the borrower's channels by day 36 with a secure path to describe their situation and start an application, sends the written notice with the options and the contacts by day 45 and again as the rule requires, records every attempt and contact with its outcome, and writes the status to servicing so the loss mitigation and foreclosure processes read it.

The problem today

The dialer called a number that had been disconnected for a year, logged it as an attempt, and the written notice went out on day 52.

Today, without Callvu

A loan goes delinquent. The dialer calls on its schedule; the calls go to a dead number; each is logged as good-faith contact. The letter is in a batch that runs weekly, so it misses day 45. The borrower, who would have answered a text and applied from their phone, hears from the servicer when the foreclosure notice arrives.

Regulation X requires good faith efforts to establish live contact by the 36th day of delinquency and, where appropriate, to inform the borrower of the loss mitigation options; a written notice by the 45th day with the options, the contacts and the application information; and repeats of both in each delinquency cycle, with exemptions for borrowers in bankruptcy and those who have invoked the cease-communication rights, and the modified requirements that go with them.

The clock starts on the day of delinquency, and the contact should start where the borrower is.

How it runs

From the requestto the system of record.

A loan becomes delinquent in the servicing system. Callvu opens the early intervention cycle on the loan with the delinquency date.

Borrower
Receives the contact attempts and the notice, and can describe their situation and start an application from any channel.
Servicing agent
Takes the live contact where the borrower responds by phone.
Servicing
Holds the delinquency status, the attempts and the outcomes.
Callvu
Classifies, schedules and makes the attempts, sends the notice, records and writes.
  1. Classify the loan

The delinquency day, the investor, the loan's exemptions (a borrower in bankruptcy, a cease-communication request under the fair debt rules, a confirmed successor), the borrower's channels and preferences, the state's requirements and any pending loss mitigation application classify the cycle's requirements and the contact plan.

  2. Establish live contact

Good faith attempts are made through the borrower's channels (a call, a text, a message, an email, a letter) on a schedule that reaches day 36 with the rule's effort, each with a secure path for the borrower to describe their situation and start a loss mitigation application; a live contact informs the borrower of the options where appropriate and records what was said.

  3. Send the written notice

The written early intervention notice with the required content (the delinquency, the encouragement to contact the servicer, the contacts, the loss mitigation options available and how to apply, the housing counseling information) is sent by day 45 and repeated as the rule requires (no more than once in a 180-day period unless the borrower becomes current and delinquent again); a borrower in bankruptcy or with a cease request receives the modified notice the rule allows.

  4. Write back

Every attempt, contact and outcome is written to the servicing system with its time and channel; a request for assistance from the contact opens the loss mitigation application; the status is read by the foreclosure referral process before any referral.

Where it ends: Every delinquent loan had the rule's contact attempts and notice on the clock, through channels the borrower uses, with every attempt recorded, and the borrower had a path to apply from the first contact. The Decision Trace shows the classification and the exemptions; the Audit Trace shows each attempt, contact and notice with its time.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The borrower's own channels, each attempt with a secure path to respond and apply.

The back office

Agents take live contacts with the record in front of them; nobody runs a batch.

The Decision Desk

  • A loan with a conflict between requirements (a bankruptcy notice, a cease request, a successor) goes to the default lead in the Decision Desk with the classification and only the allowed contact plans.

Questions

What buyers ask next,answered plainly.

When must live contact be attempted?

With good faith efforts by the 36th day of delinquency, and after each due date while the borrower stays delinquent, through channels the borrower uses.

What is in the written notice?

A statement encouraging contact, the servicer's contacts, the loss mitigation options and how to apply, and housing counselor information, by day 45 and not more than once in 180 days.

What about a borrower in bankruptcy?

The classification applies the exemption and the modified notice the rule allows, and the contact plan respects the stay and any cease request.
