Deed in lieu of foreclosure
How do we verify title, occupancy and hardship for a deed in lieu of foreclosure, get it approved under the investor's rules, and execute it correctly?
Run the deed in lieu as a verified package with an executed deed at the end. Callvu classifies the investor's program and its requirements, collects the hardship and financial documents from the borrower through a link, orders the title search and the valuation, checks for subordinate liens and the property's condition and occupancy, routes the decision to the loss mitigation underwriter in the Decision Desk and to the investor where required, generates the deed in lieu agreement with the terms (the deficiency waiver, the relocation assistance, the vacate date), captures the borrower's signatures with notarization, records the deed, and writes the outcome to servicing.

The problem today
The deed was accepted with a second lien still of record, and the lender took the property subject to it.
A borrower who has exhausted the other options offers the property back. The servicer accepts in principle, sends an agreement, and the borrower signs. The title search that would have shown the home equity line from another lender was never ordered. The property is also occupied by a tenant whose lease the lender now has to honor.
The investors require, before a deed in lieu: a title search clear of subordinate liens (or their release), confirmation of the hardship and the financials, a valuation, a property inspection, the property vacant or the occupancy handled under the program, a marketing period in some programs, and the approval authority. The agreement sets the deficiency treatment and the assistance.
A deed in lieu is a title transaction first and a loss mitigation outcome second.
How it runs
From the requestto the system of record.
A borrower requests a deed in lieu, or the loss mitigation evaluation (often after a short sale attempt) routes to one. Callvu opens the case on the loan.
- Borrower
- Provides the documents, confirms occupancy, signs the agreement and the deed, and vacates by the date.
- Title company
- Searches title, handles subordinate lien releases and records the deed.
- Loss mitigation underwriter
- Decides in the Decision Desk.
- Investor
- Approves where the program requires.
- Callvu
- Classifies, chases, orders title and valuation, checks, routes, generates documents, captures signatures and writes.
Chase and verify
The investor's program sets the requirements; the borrower's hardship statement, financials, tax authorization and occupancy statement are collected through a link and checked; the title search is ordered and read for subordinate liens, judgments and tax liens; the valuation and a property inspection are ordered; the occupancy and condition are verified.
Resolve title and conditions
Subordinate liens are negotiated for release within the program's limits through the title company; a tenant occupancy is classified under the program's rules; the marketing period requirement, where the program has one, is checked against the listing history; the net benefit to the investor is computed against the valuation.
Decide
The loss mitigation underwriter decides in the Decision Desk with the verified package and only the allowed outcomes (approve with terms, decline with reasons, or submit to the investor); the agreement is generated from the decision with the deficiency waiver or reservation, the relocation assistance and the vacate date.
Execute, record and write back
The borrower signs the agreement and the deed with notarization (and the estoppel affidavit where the state requires), the title company records the deed and issues the policy, the property is confirmed vacant and secured, and the outcome (the loan satisfied, the deficiency treatment, the assistance paid, the credit reporting) is written to the servicing system with the property handed to the real estate owned process.
Where it ends: The deed in lieu was taken on a verified title with the liens handled, the hardship and occupancy confirmed, the decision under the investor's rules, and the deed executed and recorded correctly. The Decision Trace shows the checks, the computation and the decision; the Audit Trace shows the documents, the signatures and the recording.
Runtime enforcement
What is enforcedwhile the work runs.
The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.
The handoff
Between the front doorand the back office.
The front door
The borrower through a link and the signing session, in any channel; the title company through its own.
The back office
The underwriter decides from a verified package; the documents are generated from the record.
The Decision Desk
- The package goes to the loss mitigation underwriter in the Decision Desk with the title, occupancy and value checks and only approve with terms, decline with reasons, or submit to the investor.
