Closing Disclosure timing

How do we deliver the Closing Disclosure so it is received at least three business days before consummation, and catch the changes that reset the clock before closing?

Count from receipt, not from sending, and watch for the three changes that restart the period. Callvu prepares the Closing Disclosure from the LOS and the settlement agent's figures, reconciles the fees against the Loan Estimate's tolerances, delivers it by the consented method, records receipt (acknowledgment or the mailbox rule), computes the earliest consummation date, and holds closing if a change to the APR beyond tolerance, the loan product, or the addition of a prepayment penalty requires a new three-day period. Corrections that do not reset the clock are issued at or before closing.

The problem today

The Closing Disclosure was emailed Friday, closing is Monday, and the rate changed on the way.

Today, without Callvu

The closer sends the Closing Disclosure as soon as the numbers are close, to make the date. The borrower opens it when they open it. The APR changed by more than the tolerance after a last-minute fee, which requires a new disclosure and a new three-day period, and nobody noticed until the title company asked.

TRID requires the borrower to receive the Closing Disclosure at least three business days (the specific definition, including Saturdays) before consummation; receipt is on acknowledgment or three business days after mailing or electronic delivery. Three kinds of changes restart the period: an APR change beyond the tolerance, a change in the loan product, and the addition of a prepayment penalty. Other changes get a corrected disclosure at or before consummation, or within 30 days after for post-closing changes.

The dates are arithmetic. The changes are classification. Both belong in the process.

How it runs

From the requestto the system of record.

The loan is cleared to close and the settlement agent's figures are available. Callvu opens the Closing Disclosure case with the scheduled consummation date.

Closing team
Reviews the prepared disclosure in the Decision Desk where the policy requires and issues it.
Borrower
Receives the Closing Disclosure by the consented method and acknowledges receipt.
Settlement agent
Provides the settlement figures and receives the final disclosure and the seller's disclosure.
Callvu
Prepares, reconciles tolerances, delivers, records receipt, computes the date, watches for resetting changes and holds closing.
  1. Prefill and reconcile

The Closing Disclosure is prepared from the LOS (the loan terms, the lender's fees, the prepaid items and escrow) and the settlement agent's figures (title and settlement charges, taxes, the seller's items), in the prescribed form. Each fee is compared with the Loan Estimate of record under its tolerance category; a violation is flagged for a lender credit before closing.

  2. Classify the delivery and the date

The delivery method follows the E-SIGN consent; the receipt rule is set (acknowledgment or the mailbox rule); and the earliest consummation date is computed under the specific business-day definition (every day except Sundays and federal holidays). The scheduled closing date is checked against it.

  3. Chase and verify receipt and changes

The disclosure is delivered and receipt is captured or deemed; the borrower is reminded to acknowledge. Every change after delivery is classified: an APR change beyond the tolerance, a product change, or an added prepayment penalty triggers a new disclosure and a new three-day period and holds closing; other changes produce a corrected disclosure at or before consummation.

  4. Write back

The Closing Disclosure of record, the delivery and receipt, the earliest consummation date, each change and correction, and the tolerance reconciliation are written to the LOS, and the settlement agent receives the final figures. Post-closing changes open the corrected disclosure process on its 30-day clock.

Where it ends: The borrower received the Closing Disclosure inside the required period under the specific business-day count, the fees were reconciled to the Loan Estimate's tolerances before closing, and any change that reset the period held closing rather than slipping past it. The Decision Trace shows the date computation and each change's classification; the Audit Trace shows the delivery, the receipt and the corrections.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The clear-to-close and the settlement agent's figures; the borrower meets the disclosure in the consented channel.

The back office

The closing team reviews what the policy reserves and sees the earliest date and any hold; the settlement agent receives final figures from the record.

The Decision Desk

  • A tolerance violation needing a cure decision, a change whose classification is ambiguous, or a request to waive the period for a personal financial emergency goes to the closing team or compliance in the Decision Desk with only the allowed outcomes.

Questions

What buyers ask next,answered plainly.

How is the three-day period counted?

From receipt (acknowledged or deemed three business days after delivery) using the specific definition that counts every day except Sundays and federal holidays; Callvu computes the earliest consummation date and the closing date cannot precede it.

Which changes restart the period?

An APR change beyond the tolerance, a change in the loan product, or an added prepayment penalty. Other changes get a corrected disclosure at or before closing.

What about a fee that went over tolerance?

It is flagged in the reconciliation and cured with a lender credit before closing, or refunded within 60 days after with a corrected disclosure.
