Changed circumstance and revised Loan Estimate

How do we record a changed circumstance the day it happens, decide whether a revised Loan Estimate is allowed, and deliver it within three business days?

Record the change at its source and start the clock on the record. When something changes (a rate lock, a new appraisal value, a borrower-requested change, a changed circumstance affecting settlement charges or eligibility), Callvu captures the event and its date from the system where it happened, classifies whether it qualifies for a revised Loan Estimate and which charges may reset, routes the at-risk cases to the disclosure desk in the Decision Desk, delivers the revised Loan Estimate inside three business days of the change, and writes the revised estimate and the borrower's acknowledgment to the LOS. The problem today

The appraisal came in low on the 3rd, the processor emailed the desk on the 9th, and the revised Loan Estimate is a tolerance cure at closing.

Today, without Callvu

A changed circumstance has a date: the day the lender received the information that established it. The revised Loan Estimate is due within three business days of that date, or the lender loses the right to reset the affected charges and pays the difference at closing. In most lenders the change is known to the processor on one day and to the disclosure desk on another, and the file shows both.

Not every change qualifies. The rule lists the reasons: a changed circumstance affecting settlement charges or eligibility, a consumer-requested revision, a rate lock, an expired Loan Estimate, a delayed settlement on a construction loan. A revised Loan Estimate issued for a reason that does not qualify, or for charges the change did not affect, does not reset the tolerance either.

The clock and the classification are both rules. Done by email, both are judgment.

How it runs

From the requestto the system of record.

A change event arrives from the system where it happened: the pricing engine (a lock), the appraisal order (a value), the LOS (a loan amount or product change), the title order (a fee), or a borrower's request. Callvu captures it with the date the lender received the information.

Loan officer
Requests borrower-driven changes and sees the clock on every change.
Processor
Records changes they learn of, through the process, on the day.
Disclosure desk
Decides at-risk cases and issues the revised Loan Estimate in the Decision Desk.
Borrower
Receives the revised Loan Estimate and acknowledges it.
Callvu
Captures the change at its source, classifies, keeps the clock, routes, delivers and writes.
  1. Capture the change on the day

The event and the date the lender received the information are recorded from the source system or from the processor's entry on the day. The clock starts on record, not when the desk notices.

  2. Classify the reason and the charges

The change is classified against the rule's reasons for a revised Loan Estimate (changed circumstance affecting settlement charges, changed circumstance affecting eligibility, consumer-requested revision, rate lock, expiration, construction delay), and the charges it affected are identified; only those may reset. A change that does not qualify is recorded as such with the reason, and no revised Loan Estimate is issued for it.

  3. Decide at-risk cases

A qualifying change with a clear reason and affected charges is prepared by rule. A change with an ambiguous reason, a charge increase above the tolerance that the change may not justify, or a clock with less than one business day left goes to the disclosure desk in the Decision Desk with the deadline and only approve, correct, or decline-to-revise as outcomes.

  4. Deliver and write back

The revised Loan Estimate is delivered inside three business days of the change by the consented method, and no later than four business days before consummation; the delivery, the receipt and the borrower's acknowledgment are written to the LOS with the change event, so the tolerance comparison at closing uses the right baseline.

Where it ends: Every change has a recorded date, a classification against the rule, and, where it qualified, a revised Loan Estimate delivered inside the clock with the acknowledgment in the LOS, so the tolerance test at closing rests on the right disclosure. The Decision Trace shows the reason and the charges reset; the Audit Trace shows the capture date, the decision and the delivery.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The systems where changes happen (pricing, appraisal, title, the LOS) and the processor's same-day entry; the borrower meets the revised Loan Estimate in the consented channel.

The back office

The disclosure desk decides only at-risk cases with the clock visible; processing records changes on the day they happen, through the process.

The Decision Desk

  • An ambiguous reason, a charge increase the change may not justify, or a clock with less than a business day left goes to the disclosure desk in the Decision Desk with only approve, correct, or decline-to-revise.

Questions

What buyers ask next,answered plainly.

When does the three-day clock start?

On the date the lender received the information that established the changed circumstance, captured from the source system or the processor's same-day entry, not when the disclosure desk learned of it.

Does every change get a revised Loan Estimate?

No. Only the reasons the rule lists qualify, and only the charges the change affected may reset. A non-qualifying change is recorded with its reason and no revision is issued for it.

What happens close to closing?

Within four business days of consummation the revision goes on the Closing Disclosure instead, which the classification handles.
