Privacy and data access requests

How do we handle a consumer's privacy or data access request with identity verified, the request type set under the right law, and the response fulfilled and logged on its clock?

Verify first, classify second, fulfil on the clock. Callvu takes the request from the consumer in any channel, verifies their identity to the level the request type requires (a match to the policy's data for an access request, a stronger step-up for deletion or for a request through an agent), classifies it under the laws that apply to the consumer and the data (an access or correction request under GLBA and the state insurance privacy laws, a deletion or opt-out request under a state consumer privacy law where insurance data is not exempt, a data security notice under NAIC Model #668), chases what is needed from the consumer or the data owners, assembles the response from the policy, claims and marketing systems, routes exceptions to the privacy officer in the Decision Desk, and writes the request, the response and the dates to the privacy log.

The problem today

The access request was answered from the policy system only; the claims file and the marketing profile were never searched.

Today, without Callvu

A consumer asks what the carrier holds about them, or asks to correct it, delete it, or stop its sharing. The request lands with whoever received it: an agent, the contact center, the privacy mailbox. Someone pulls the policy record and sends it. The claims notes, the recorded calls, the marketing segments and the data the carrier bought from a vendor are not included, and the state's deadline has passed by the time the consumer writes again.

Three sets of rules can apply at once: GLBA and the state insurance privacy laws (the NAIC Privacy of Consumer Financial and Health Information Regulation, Model #672, and the older Model #670 in many states) give the consumer access and correction rights to personal information and limit sharing, with their own periods; the state consumer privacy laws (California, Virginia, Colorado and the others) add access, deletion, portability and opt-out rights with a forty-five day response period where insurance data is not exempt; and NAIC Model #668 sets the data security program and breach notification. Which rules apply depends on the consumer's state, the data and the request type, and the classification decides it.

Identity verification before disclosure is the step that turns a privacy request into a privacy breach when it is skipped.

How it runs

From the requestto the system of record.

A consumer (or their authorized agent) makes a privacy request in any channel: access, correction, deletion, portability, opt-out of sharing or marketing. Callvu opens the request.

Consumer or authorized agent
Makes the request, verifies identity on a secure screen and receives the response.
Data owners (policy, claims, marketing, vendors)
Supply or act on the data through tasks.
Privacy officer
Decides exceptions and exemptions in the Decision Desk.
Callvu
Verifies, classifies, chases, assembles, routes and logs.
  1. Verify identity

The consumer verifies on a secure screen to the level the request requires: a match of several data points for an access request, a stronger step-up (a one-time code to a contact on record, a document check) for deletion or correction, and the agent's authorization plus the consumer's confirmation for a request through an authorized agent; an unverifiable request is answered with what verification is needed, and nothing is disclosed.

  2. Classify the request

The request type, the consumer's state, their relationship (policyholder, claimant, applicant, beneficiary, employee) and the data in question classify the laws that apply and the clock: GLBA and the state insurance privacy law for access and correction of financial and health information, the state consumer privacy law where the data is not covered by the GLBA exemption, and the opt-out rights for sharing with non-affiliates and for marketing; the exemptions (information in a claim under investigation, privileged material) are flagged for the privacy officer.

  3. Chase and verify the data

The request is split into tasks for the data owners: the policy system, the claims system, the contact center recordings, the marketing platform and the vendors holding the consumer's data under contract; each returns the data or confirms the action (correction, deletion, suppression) through a structured task, and the case shows what is outstanding against the internal due date.

  4. Respond and write back

The response is assembled (the data in a portable format, the correction confirmed, the deletion confirmed with the exceptions explained, the opt-out applied across the systems), reviewed by the privacy officer in the Decision Desk where an exemption or a partial denial applies, sent to the consumer within the clock, and the request, the verification, the classification, the actions and the dates are written to the privacy log the regulators and the auditors examine.

Where it ends: The consumer was verified before anything was disclosed, the right laws set the clock, every system that holds their data answered, and the response and the log are complete. The Decision Trace shows the verification level, the classification and any exemption decision; the Audit Trace shows the request, each system's action and the response with their times.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

Any channel; the consumer verifies and receives the response on a secure screen.

The back office

Data owners act on tasks; the privacy officer sees only exemptions and partial denials; the log fills itself.

The Decision Desk

  • An exemption claim, a partial denial or a request through an agent with unclear authority goes to the privacy officer in the Decision Desk with the classification and only fulfil, fulfil in part with the explanation, or deny with the reason and the appeal path.

Questions

What buyers ask next,answered plainly.

How is the consumer verified?

On a secure screen to the level the request requires: a data match for access, a step-up for deletion or correction, and the agent's authorization plus the consumer's confirmation for a request through an agent.

Which law applies?

The classification decides from the consumer's state, relationship and data: GLBA and the state insurance privacy law for financial and health information, the state consumer privacy act where the GLBA exemption does not cover the data, each with its own clock.

Which systems are searched?

Every system and vendor holding the consumer's data: policy, claims, call recordings, marketing and contracted vendors, each through a task the case tracks.
