Repossession and right-to-cure notices

How do we send right-to-cure and repossession notices on time, in the right form for the state, and record the responses before a vehicle is recovered?

Make the notices a sequence the process runs from the trigger. When a loan reaches the delinquency trigger, Callvu classifies the state's requirements for the loan and the collateral, produces each notice in the state's form (the right to cure, the notice of default, the post-repossession notice and the deficiency notice where they apply), delivers it by the method the statute requires, tracks each period, records the borrower's responses and cures, and releases the recovery order to the vendor only when the periods have run.

The problem today

The repossession was lawful in one state and a violation in the next, and the notice was a template.

Today, without Callvu

A borrower on an auto loan is 60 days past due. Collections orders a repossession. The state required a notice of the right to cure with a 20-day period before any repossession, in a specific form, sent by a specific method. It was not sent, or it was sent in another state's wording. The borrower sues; the deficiency is uncollectible; the bank pays.

Repossession is governed by UCC Article 9 (commercially reasonable disposition, the notice before disposition, the deficiency and surplus) and by state right-to-cure and consumer credit laws that vary in the period, the form, the delivery method and when a second notice may be required. For servicemembers, repossession without a court order is barred. Each state's rules are a configuration, not a judgment call for a collector.

The sequence is date-driven and the proof is the notice, the delivery record and the response.

How it runs

From the requestto the system of record.

A loan reaches the delinquency or default trigger the bank's policy sets. Callvu classifies the state's requirements for the borrower's address and the collateral and opens the notice sequence.

Collections
Sees the sequence and its dates, records contact, and decides exceptions in the Decision Desk.
Recovery vendor
Receives the recovery order only when the process releases it, with the documents it needs.
Borrower
Receives each notice, may cure within the period, and receives the post-repossession and deficiency notices.
Callvu
Classifies, produces and delivers notices, tracks periods, records responses, releases recovery and records every step.
  1. Classify the requirements

The state of the borrower's address, the collateral type and the loan type set the notices and periods: a right-to-cure notice with its period and form where the state requires one, a notice of default, any required second notice, the delivery method (first-class mail, certified mail, both), and any bar on repossession (an SCRA indication, a bankruptcy notice, a pending relief request).

  2. Produce and deliver the notices

Each notice is produced in the state's form with the loan's figures (the amount to cure, the date, the consequences) and delivered by the required method, with the delivery record attached. The period runs from the delivery rule the statute sets.

  3. Chase and verify responses

A cure payment, a dispute, a relief request or a contact is recorded on the case and stops or pauses the sequence as the rules require. The case shows the period's end date and the days left.

  4. Decide and release

When the periods have run without cure and no bar applies, the recovery order is released to the vendor by rule, with the documents it needs. A borrower contact that raises a question, an SCRA or bankruptcy indication, or a policy exception goes to collections in the Decision Desk before any release.

  5. After recovery

The post-repossession notice (the notice of the right to redeem and of the disposition) and, after sale, the deficiency or surplus notice are produced and delivered on their clocks under Article 9, and every notice, delivery and response is written to the loan and collections systems.

Where it ends: Every notice went out in the state's form and method inside its period, every response was recorded, recovery was released only when lawful, and the post-recovery notices followed. The Decision Trace shows the state rules applied and the release decision; the Audit Trace shows every notice, delivery and response. The Callvu moves in this process are classify, chase and verify and write back. The systems named here stay the system of record; Callvu writes to them and keeps the trace.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The delinquency trigger. The borrower meets the process in the notices and can cure or respond from them.

The back office

Collections sees a sequence with dates, not a template folder; the recovery vendor receives only lawful orders.

The Decision Desk

  • A borrower question, an SCRA or bankruptcy indication, a relief request, or a policy exception goes to collections in the Decision Desk before any release, with only the allowed outcomes.

Questions

What buyers ask next,answered plainly.

How does the process know which notice a state requires?

The state of the borrower's address, the collateral and the loan type classify the sequence from the configured statutes: the form, the period, the delivery method and any second notice.

When is the recovery order released?

Only when the cure period has run without cure, no bar (SCRA, bankruptcy, a pending relief request) applies, and no question is open in the Decision Desk.

What follows a repossession?

The notice of disposition and, after sale, the deficiency or surplus explanation under Article 9, produced and delivered on their clocks and recorded.
