Bankruptcy notice handling
How do we act on a bankruptcy filing notice the day it arrives, with every account coded, collection stopped and the case recorded?
Make the notice a trigger the process runs at once. When a filing notice arrives, Callvu finds every account for the debtor, codes each one with the chapter and the case number, stops collection contact and automatic actions under the automatic stay, routes the questions legal must answer (a reaffirmation, a proof of claim, a relief from stay) in the Decision Desk, and records the case with its dates so the bank can show it stopped on time.

The problem today
The notice sits in a mailbox for a week, and the dialer keeps calling a debtor who is under the stay.
A notice of bankruptcy arrives from the court, the debtor's attorney, or the debtor on a call. It is routed to whoever handles bankruptcies. Meanwhile collections calls, a late fee posts, a repossession order goes out. Each is a violation of the automatic stay, with damages, fees and sanctions, and the trustee's counsel knows how to find them.
The automatic stay takes effect the moment the petition is filed, whether or not the bank has been served. The bank's exposure runs from when it knew. The protection is speed and scope: every account, every action, the day the bank learns of it.
After the stop come the legal steps with their own deadlines: the proof of claim, a reaffirmation agreement, a motion for relief from stay, and the discharge or dismissal that ends the case.
How it runs
From the requestto the system of record.
A bankruptcy notice arrives by mail, from the court's electronic notice service, from an attorney, or from a debtor in any channel. Callvu captures it with the date and time of receipt and finds every account for the debtor.
- Collections
- Sees the stop on every account and stands down; routes any contact from the debtor to the case.
- Legal
- Decides the claim, reaffirmation and relief questions in the Decision Desk on their deadlines.
- Callvu
- Captures, finds accounts, codes, stops actions, routes legal steps, tracks deadlines and records.
Capture and classify
The notice is read: the debtor, co-debtors, the chapter (7, 11, 13), the case number, the court, the filing date, the trustee and the meeting of creditors date. The debtor is matched to every account and obligation in the core, the loan systems and the card system, and the co-debtor stay in a Chapter 13 is applied where it holds.
Stop and code
Each account is coded with the chapter and case number, collection contact is stopped, automatic late fees and interest treatment follow the policy for the chapter, repossession and foreclosure sequences are halted, setoff is held, and the credit reporting treatment is set. The time the stop was applied is recorded against the time of receipt.
Decide the legal steps
Legal receives the case in the Decision Desk with the accounts, the balances, the collateral and the deadlines: file a proof of claim by the bar date, pursue a reaffirmation agreement, seek relief from stay for collateral, or monitor. Each decision is recorded with the person.
Write back and track to the end
The codes, the stop, the legal decisions and the filings are written to the core, the loan systems and the collections system. The case tracks the plan payments in a Chapter 13, the discharge or dismissal, and what happens to each account at the end (discharged, reaffirmed, surrendered), and reopens collection only where the law allows.
Where it ends: Every account of the debtor was coded and stopped the day the bank learned of the filing, the legal steps ran on their deadlines, and the case ended with each account's treatment recorded. The Decision Trace shows the classification and each decision; the Audit Trace shows the receipt time, the stop time and every step.
Runtime enforcement
What is enforcedwhile the work runs.
The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.
The handoff
Between the front doorand the back office.
The front door
The court's notice, an attorney's letter, or the debtor in any channel. The notice is read the day it arrives.
The back office
Collections stands down on every account at once; legal works the case from the Decision Desk with the deadlines visible.
The Decision Desk
- Legal decides the proof of claim, reaffirmation, relief from stay and monitoring questions in the Decision Desk with the accounts, the collateral and the deadlines, and only the allowed outcomes.

The same day the bank learns of the filing, on every account the debtor holds, with the receipt and stop times recorded.
What about a co-signer?
In a Chapter 13 the co-debtor stay is applied to the co-obligor on consumer debts, where it holds.
Who files the proof of claim?
