SCRA benefit request

How do we apply SCRA benefits when a servicemember asks, with the orders verified, the 6 percent cap applied back to the right date and the protections flagged across accounts?

Run the request as one case across every account the servicemember holds. Callvu identifies the borrower, collects the military orders or checks the Department of Defense database, verifies the active duty dates, applies the interest rate cap to each covered obligation from the date the statute requires with the refund of excess interest, flags the accounts for the other protections (no default judgments, no repossession or foreclosure without a court order, lease and fee rules), and writes the changes to the loan and core systems with the dates.

The problem today

The cap is applied to the loan the servicemember mentioned, and not to the card they forgot.

Today, without Callvu

A servicemember calls about a car loan and sends a copy of their orders. The servicing team lowers the rate on that loan from the date of the call. The credit card and the mortgage at the same bank are untouched; the cap should have applied to them too, from the date military service began, with the excess interest refunded. A year later a default judgment is entered on the card because nobody flagged it.

The Servicemembers Civil Relief Act is specific: a 6 percent cap on interest (including fees) on obligations incurred before military service, applied retroactively to the date service began once the servicemember gives written notice with orders, within 180 days after service ends; no default judgments without an affidavit of military service; no repossession, foreclosure or lease termination without a court order on covered obligations. Regulators and the Department of Justice enforce it aggressively, and the remedies include refunds across the whole portfolio.

The request is simple to take and easy to apply narrowly. The control is the scope.

How it runs

From the requestto the system of record.

A servicemember, a dependent or a representative asks for SCRA benefits in any channel, or the bank's periodic database check indicates active duty. Callvu identifies the borrower and finds every account and obligation they hold.

Borrower
Provides the written request and the orders, or consents to the database check, and receives the confirmation of each benefit applied.
Loan servicing
Sees every covered obligation with its change and decides exceptions in the Decision Desk.
Callvu
Finds the obligations, verifies service dates, applies the cap and refunds, flags protections, and writes to the systems.
  1. Find and classify the obligations

Every account for the servicemember (and a co-borrower spouse where the statute covers them) is found in the core and the loan systems and classified: incurred before or after the service start date, and the obligation type. Pre-service obligations are covered by the cap; all are flagged for the court-order protections.

  2. Chase and verify service

The written request and the orders are collected on the borrower's phone, or the Department of Defense Manpower Data Center status is checked with consent. The active duty start date and, where known, the end date are recorded. The request is valid if made during service or within 180 days after it ends.

  3. Decide and apply

The 6 percent cap is applied to each pre-service obligation from the service start date, the excess interest and fees already charged are refunded, the payment is reduced accordingly (not deferred), and the accounts are flagged for the protections against default judgments, repossession, foreclosure and lease termination. An obligation the classification cannot resolve, a disputed date, or a request after the window goes to loan servicing in the Decision Desk.

  4. Write back

The rate change, the refund, the flags, the service dates and the end-of-service review date are written to the loan and core systems and the collections system, and the borrower receives a confirmation listing every account and benefit. The end-of-service date opens a review for the cap's continuation period on mortgages.

Where it ends: Every obligation the servicemember holds carries the cap or the flag it should, from the right date, with refunds posted and the confirmation sent, and the systems of record run on the new terms. The Decision Trace shows the classification and the dates; the Audit Trace shows the orders, the changes and the notices.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

Any channel, or the bank's own database check. The orders are uploaded on the servicemember's phone.

The back office

Loan servicing sees every covered obligation changed from one case; collections, repossession and foreclosure processes see the flags.

The Decision Desk

  • An obligation that cannot be classified, a disputed service date, or a request after the window goes to loan servicing in the Decision Desk with the case and only the allowed outcomes.

Questions

What buyers ask next,answered plainly.

Does the cap apply to all the servicemember's accounts?

To every obligation incurred before service, found across the bank's systems from one request, from the service start date, with refunds. All accounts are flagged for the other protections.

What if the servicemember has no copy of the orders?

With consent, the Department of Defense database is checked and the result recorded.

How are the other protections enforced?

Flags written to every account, which the collections, repossession and foreclosure processes check before any action.
