Subpoenas, levies and garnishments
How do we handle subpoenas, garnishments and levies with the account search, the protected-funds rule, the hold and the response done on the order's deadline?
Treat every piece of legal process as a case with the order's own rules. When process is served, Callvu classifies the order (a subpoena for records, a garnishment, a levy, a court order), searches the core for every account of the named party, applies the federal benefit garnishment rule to protect exempt deposits before any hold, places the hold or produces the records as the order requires, routes legal's review in the Decision Desk, sends the response and the customer notice on the deadline, and records every step.

The problem today
The garnishment froze the account, including the Social Security deposit the rule says to protect.
A garnishment order arrives by mail or fax. Someone searches the core by the name on the order, freezes what they find, and sends the response when the pile is worked. The account held two months of Social Security payments, which the federal rule required the bank to protect before freezing anything. The customer cannot pay rent, the bank is liable, and the examiner cites it.
Legal process comes in kinds with different rules: a subpoena for records (with the Right to Financial Privacy Act's notice and certification for federal subpoenas), a garnishment or levy (with the federal benefit garnishment rule's two-month lookback and the state's exemptions), an IRS levy with its 21-day hold, a court order with its own terms. Each has a deadline, a form of response, and a customer notice the bank owes or is barred from giving.
The volume is steady and the search is where mistakes start: a common name, a joint account, a business owner's personal account.
How it runs
From the requestto the system of record.
Legal process is served on the bank by mail, fax, electronic service or in person. Callvu captures it with the date and time of service and opens the case.
- Legal process team
- Works the case in the Decision Desk: confirms the match, the protected funds, the hold and the response.
- Deposit operations
- Executes holds and releases from the decided case.
- Legal
- Reviews orders the policy reserves and disputes.
- Callvu
- Classifies, searches, applies the protected-funds rule, routes, produces responses and notices on the deadlines, and records.
Classify the order
The order is read: its type (records subpoena, garnishment, levy, IRS levy, court order, search warrant), the issuing authority, the named party and identifiers, the amount or the records demanded, the response deadline and the form of response, and whether a customer notice is required or prohibited. The classification sets the steps and the clocks.
Search and match
The core is searched for every account and safe deposit box of the named party by name, taxpayer identification number, address and date of birth; joint accounts and business accounts are identified with their other owners. A doubtful match goes to the legal process team before any action.
Protected funds before any hold
For a garnishment or levy, the two-month lookback for federal benefit payments is run on each account, the protected amount is computed and left available, and the notice to the account holder with the required content goes out within the rule's period. State exemptions and the IRS levy's own rules are applied as the classification set.
Decide, hold and respond
The legal process team confirms in the Decision Desk with the match, the protected-funds computation and the order's terms, and only the allowed outcomes. Deposit operations places the hold on the non-protected amount or produces the records from the decided case. The response (the answer to the garnishment, the records with the certification, the levy remittance after its hold period) goes out on the deadline, and the customer notice is sent or withheld as the order and the law require.
Write back
The order, the search, the computation, the hold and its release or remittance, the response and the notices are written to the core and the legal process log, with every date, and the fee the agreement allows is applied.
Where it ends: The order was answered on its deadline with the right accounts, the protected funds left available, the hold and the response correct for the order's type, and the customer notice sent or withheld as required. The Decision Trace shows the classification and the computation; the Audit Trace shows the service time, each step and each date. The Callvu moves in this process are classify, chase and verify, decide and write back.
Runtime enforcement
What is enforcedwhile the work runs.
The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.
The handoff
Between the front doorand the back office.
The front door
Service of process by mail, fax, electronic service or in person. The customer meets the process in the notice, where one is required.
The back office
The legal process team confirms in the Decision Desk with the search and the computation done; deposit operations executes from the decided case; legal reviews the reserved orders.
The Decision Desk
- The legal process team confirms the match, the protected funds and the hold in the Decision Desk with only the allowed outcomes; a reserved order or a dispute goes to legal.

Questions
What buyers ask next,answered plainly.
What happens before a garnishment hold?
The two-month lookback for federal benefit deposits runs on each account, the protected amount is computed and left available, and the customer notice goes out within the rule's period. The hold applies only to the rest.
How is the right customer found?
By name, taxpayer identification number, address and date of birth across the core, with joint and business accounts identified. A doubtful match is confirmed by a person first.
What about an IRS levy?
The funds are held for 21 days before surrender, with the timer on the case.
