Bankruptcy notice handling
How do we log a customer's bankruptcy notice, stop collection the same day, and flag the account for the legal team with the case details recorded?
Treat the notice as an event that changes the account's state at once. When a bankruptcy notice arrives (from the court, the customer, their attorney or a scrub against the court records), Callvu reads and classifies it (the chapter, the court, the case number, the filing date, the debtors against the account holders, the bar date, whether the account is listed), applies the automatic stay flags on the account the same day (collection calls and letters stopped, the dunning and the suspension for pre-petition debt halted, the agency recalled, the late fees suspended, the credit reporting adjusted), chases the attorney or the customer for the case details where the notice is incomplete, routes the account to the legal team in the Decision Desk with the post-petition service decision, and writes the case and the flags to the billing system and the collections system so every process reads them. The problem today
The customer filed on Tuesday, the dunning text went out on Wednesday, and the sanctions motion arrived the next month.
A bankruptcy notice arrives in the mailroom, or the customer mentions it to an agent who notes it. The collections system does not know; the dunning continues; the service is suspended for the pre-petition balance; the agency keeps calling. Each is a violation of the automatic stay, and the debtor's attorney knows how to turn it into damages.
The stay takes effect on filing, not on the carrier's notice, and it stops any act to collect a pre-petition debt, including suspension of service for it (with the utility provisions allowing a deposit for post-petition service on their own terms). The carrier needs the case details to file a claim by the bar date and to decide post-petition service. The flags are how every system knows; the legal team is who decides.
A notice that changes the account's state the same day is a stay the carrier can prove it honored.
How it runs
From the requestto the system of record.
A bankruptcy notice arrives from the court, the customer, their attorney, or a scrub against the court records. Callvu reads it and opens the case on the account.
- Customer or their attorney
- Provides the notice or the case details, and receives communications only as the stay allows.
- Legal team
- Owns the account from routing: the proof of claim, the post-petition service and the deposit decisions, in the Decision Desk.
- Collection agency
- Receives the recall and stops.
- Callvu
- Reads, classifies, applies the flags, chases, routes and writes.
Classify the notice
The notice is read for the chapter (7, 13 or 11), the court and the case number, the filing date, the debtors (matched against the account holders and the authorized users), the trustee, the bar date and whether the carrier is listed as a creditor; a notice from a scrub or a verbal mention is classified as unconfirmed with the court record check started.
Apply the stay flags
The account is flagged from the filing date: collection calls, texts and letters stopped, the dunning and the pre-suspension cycle halted for the pre-petition balance, a suspension for that balance prevented, the agency placement recalled, late fees suspended, the credit reporting adjusted to the bankruptcy status, and the pre-petition and post-petition balances separated in the billing system.
Chase and verify, and decide
Where the notice is incomplete the case details are chased from the attorney or the customer through a link, and the court record is checked; the account goes to the legal team in the Decision Desk with the case and only the allowed outcomes: file the proof of claim by the bar date, decide post-petition service and the deposit the utility provisions allow, treat a co-holder outside the case under their own rules, or close the case on a dismissal; a repeat filing's stay limits are flagged for the team.
Write back
The case details, the flags, the balances and the legal team's decisions are written to the billing system and the collections system, the post-petition charges bill on their own cycle, the discharge or dismissal event ends the case and resets the account's state through the same process, and every step is on the record for the stay's proof.
Where it ends: The stay was honored from the filing date because the account's state changed the day the notice arrived, the legal team owns the case with the bar date in view, and the billing system, the system of record, and the collections system hold the flags and the balances. The Decision Trace shows the classification, the flags and the decisions; the Audit Trace shows the notice, each flag and each filing with time.
Runtime enforcement
What is enforcedwhile the work runs.
The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.
The handoff
Between the front doorand the back office.
The front door
The notice from any source, including a mention to an agent; the attorney through a link.
The back office
The legal team owns the account with the case on screen; every other system reads the flags.
The Decision Desk
- The account goes to the legal team in the Decision Desk with the case and only file the claim, decide post-petition service and the deposit, handle a co-holder outside the case, or close on dismissal.

Questions

Can the carrier keep providing service?
It must not cut service for the pre-petition debt, and may require a deposit for post-petition service within the period the Code allows; the legal team decides.
