Partial release and subordination

How do we document, approve and record a request to release part of the collateral or subordinate the lien?

Run it as a credit decision with a recording at the end. Callvu takes the request (a partial release of land, an easement, a lot split, a subordination to a new lien), collects what the decision needs from the borrower and the title company (the survey or legal description, the new lien's terms, a valuation of the remaining collateral), tests the request against the investor's rules and the lender's policy, routes the credit decision in the Decision Desk, prepares the release or subordination agreement, captures signatures, and records it with the county and in servicing.

The problem today

The borrower sold two acres, the release was signed by someone without authority, and the investor never consented.

Today, without Callvu

A borrower wants to sell part of the land, grant a utility easement, or take a second mortgage that needs the first to subordinate. The request reaches servicing by letter. Someone drafts a release, someone signs it, and it is recorded. The investor's consent was required; the remaining collateral's value was never checked; the person who signed lacked authority.

Partial releases and subordinations change the lender's security, and the investor's guidelines set when they are allowed, what must be verified (the remaining loan-to-value, the terms of the new lien, that the released part does not include the dwelling), and who must approve. The instrument must be properly executed and recorded.

It is a credit decision, a legal document and a recording, in that order.

How it runs

From the requestto the system of record.

A borrower (or their attorney, title company or a new lender) requests a partial release or a subordination. Callvu opens the case on the loan.

Borrower
Requests, provides the documents, pays the fee and signs where required.
Title company
Provides the survey, legal description or the new lien's commitment, and records the instrument.
Credit
Decides the request in the Decision Desk.
Servicing
Prepares the instrument from the decision and updates the loan.
Callvu
Classifies, collects, tests, routes, prepares, captures signatures and records.
  1. Classify the request

The request type (partial release, easement, subordination to a new lien, lot split) and the loan's investor and program classify the rules: whether the investor allows it, the conditions (remaining loan-to-value, no release of the dwelling, the new lien's terms and amount), the fee, and the approval authority.

  2. Chase and verify

The documents the decision needs are requested through links: the survey or legal description of the released parcel, the sale contract or the easement, a valuation of the remaining collateral where the rules require, the new lien's terms and commitment for a subordination; each is read and checked against the conditions.

  3. Decide

Credit decides in the Decision Desk with the tests and the documents, and only the allowed outcomes: approve, approve with conditions (a paydown, a fee), or decline with reasons; the investor's consent is obtained through its channel where required and recorded.

  4. Document, record and write back

The release or subordination agreement is prepared from the decision, signed by an authorized officer (and the borrower where required) on process-controlled screens or with a notary where the state requires, delivered to the title company for recording, the recorded instrument is received and filed, and the loan's collateral record and the lien position are updated in servicing.

Where it ends: The request was tested against the investor's rules, decided by credit, documented by an authorized signer, recorded, and reflected in the loan's collateral record. The Decision Trace shows the classification, the tests and the decision; the Audit Trace shows the documents, the signatures and the recording.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

The borrower, their attorney, the title company or the new lender, in any channel.

The back office

Credit decides from tests; servicing prepares and records from the decision.

The Decision Desk

  • Credit decides in the Decision Desk with the tests and the documents, and only approve, approve with conditions, or decline with reasons; a request needing the investor's consent waits for it on the record.

Questions

What buyers ask next,answered plainly.

What is checked before a partial release?

The investor's conditions: the remaining loan-to-value, that the dwelling is retained, the use of the proceeds, and the investor's consent where required, from the survey, the contract and a valuation.

Who signs the release?

An authorized officer, from the credit decision, with the acknowledgment the state requires, and the title company records it.

What about a subordination?

The new lien's amount, terms and purpose are tested against the subordination rules, and the agreement is prepared and recorded the same way.
