Loan assumption

How do we process a loan assumption with the new borrower's application underwritten, the documents collected and the original borrower's release recorded?

Run the assumption as an application with a release at the end. Callvu determines whether the loan is assumable under its terms and the investor's rules, prefills the loan, takes the new borrower's application and consents on a secure screen, collects and verifies their documents through the document processes, routes the underwriting decision in the Decision Desk, prepares the assumption agreement and the release of the original borrower, captures signatures, and writes the assumption to servicing with the new borrower and the release.

The problem today

The assumption took four months of emails, and the original borrower was never released.

Today, without Callvu

A buyer wants to assume a seller's loan, or a divorce or a death transfers the property to someone who wants the loan. The servicer's assumptions desk handles it by email: an application form, a document list, an underwriting review when the file is complete, and an agreement drafted by legal. The original borrower, who thought they were released, finds out later they were not.

Assumptions follow the note's terms (the due-on-sale clause and its exceptions), the investor's assumption rules and their underwriting requirements, and the Garn-St Germain exemptions for transfers to relatives and on death or divorce, which require no underwriting. The release of the original borrower is a separate agreement with its own signatures.

It is a loan application plus a release, and it should run like one.

How it runs

From the requestto the system of record.

A request to assume a loan arrives from the original borrower, the new borrower, a settlement agent or an attorney. Callvu classifies the assumability and opens the case.

Original borrower
Consents to the assumption and signs the release.
New borrower
Applies, gives consents, provides documents and signs the assumption agreement.
Underwriter
Decides the new borrower's qualification in the Decision Desk where underwriting is required.
Servicing
Books the assumption and the release.
Callvu
Classifies, prefills, collects, verifies, routes, prepares documents, captures signatures and writes.
  1. Classify assumability

The loan's program and note terms (assumable with qualification, assumable without, not assumable), the investor's rules, and the transfer type (a sale, a transfer to a relative, a transfer on death or divorce under the Garn-St Germain exemptions) classify whether the assumption is allowed and whether underwriting is required.

  2. Chase and verify the new borrower

Where underwriting is required, the new borrower completes the application and consents on a secure screen, and income, assets, identity and credit are collected and verified through the document and verification processes; where it is not, the identity and the transfer documents are collected.

  3. Decide

The underwriter decides qualification in the Decision Desk with the file and only the allowed outcomes (approve, approve with conditions, decline with the adverse action process); an exempt transfer is approved by rule on the documents.

  4. Document and write back

The assumption agreement, the release of the original borrower (where the investor and the lender allow it), and the notices are prepared from the record and signed on each party's phone or at a table where the state requires; the assumption, the new borrower, the release and the documents are written to servicing, and the credit reporting and the escrow are updated.

Where it ends: The assumption was classified under the note and the rules, the new borrower was underwritten through the standard processes where required, and the agreement and the release were signed and booked in servicing. The Decision Trace shows the classification and the decision; the Audit Trace shows each party's steps and the write.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

Any party's request; the new borrower applies on a secure screen; the original borrower consents and signs on theirs.

The back office

Underwriting decides from a verified file; servicing books from signed documents; legal drafts nothing by hand.

The Decision Desk

  • The underwriter decides qualification in the Decision Desk with the file; a release the investor conditions, or a transfer whose exemption is unclear, goes to the servicing manager or legal with only the allowed outcomes.

Questions

What buyers ask next,answered plainly.

Which loans can be assumed?

Those the note and the program allow; FHA and VA loans with qualification; and transfers exempt under Garn-St Germain (to a relative on death, to a spouse or child, under a divorce decree) without qualification. The classification decides.

Is the new borrower underwritten?

Where the rules require it, through the same application, document and verification processes as a new loan, with the same consents.

Is the original borrower released?

Where the investor and the lender allow it, by a separate signed release recorded on the loan.
