Servicemember protections request

How do we apply SCRA benefits on a mortgage when a servicemember submits orders, with eligibility checked and the rate cap and protections applied in servicing?

Verify the service and apply every benefit the Act gives the mortgage. Callvu collects the written request and the orders on the servicemember's phone (or checks the Department of Defense database with consent), verifies the active duty dates against the loan's origination date, applies the 6 percent interest cap retroactively to the service start date with the refund and the reduced payment, flags the loan against foreclosure without a court order during service and for a year after, applies the other protections, and writes the changes to servicing with the dates and the end-of-service review.

The problem today

The rate was capped on the month the orders arrived, not the month service began, and the foreclosure flag was never set.

Today, without Callvu

A servicemember sends orders and asks for the SCRA rate cap. The analyst lowers the rate from the date of the letter. The Act applies the cap from the date military service began, and requires the excess interest to be forgiven and the payment reduced accordingly. The loan is also protected from foreclosure without a court order during service and for a year after, which the default team needs to see.

The Department of Justice and the regulators have enforced the mortgage provisions aggressively, and the remedies reach the whole portfolio. The database check before a foreclosure referral is a separate control the foreclosure process runs.

The benefits are a computation and a set of flags, from verified dates.

How it runs

From the requestto the system of record.

A servicemember, a dependent or a representative requests SCRA benefits on the mortgage in any channel, or a database check indicates active duty. Callvu opens the case on the loan.

Servicemember
Provides the written request and the orders, or consents to the database check, and receives the confirmation.
Servicing analyst
Decides exceptions and confirms the application of benefits in the Decision Desk.
Callvu
Collects and verifies, computes the cap and refund, applies the flags, writes to servicing and schedules the review.
  1. Chase and verify service

The written request and the orders are uploaded on the servicemember's phone, or the Department of Defense Manpower Data Center status is checked with consent; the active duty start date (and end date where known) is verified and compared with the loan's origination date, since the cap applies to obligations incurred before service.

  2. Classify and compute

The loan is classified as pre-service (cap applies) or not; the 6 percent cap is computed from the service start date, including fees and charges the Act treats as interest, with the excess forgiven and refunded and the periodic payment reduced; the request window (during service or within 180 days after) is checked.

  3. Decide and apply

A verified pre-service loan is applied by rule; a disputed date, a request outside the window, or a loan with a co-borrower spouse question goes to the servicing analyst in the Decision Desk. The foreclosure protection flag (no foreclosure or sale without a court order during service and for one year after) and the other protections are set on the loan.

  4. Write back

The rate change, the refund, the reduced payment, the flags, the service dates and the end-of-service review date are written to the servicing system and the escrow is re-analyzed; the servicemember receives the written confirmation, and the default and foreclosure processes see the flag.

Where it ends: The cap was applied from the right date with the refund, the foreclosure protection is flagged for the whole period, and servicing runs on the new terms with a review scheduled for the end of service. The Decision Trace shows the dates and the computation; the Audit Trace shows the orders, the changes and the confirmation.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

Any channel; the orders uploaded on the servicemember's phone.

The back office

Servicing applies the benefits by rule; default and foreclosure see the flag.

The Decision Desk

  • A disputed service date, a request outside the window, or a co-borrower question goes to the servicing analyst in the Decision Desk with the dates and only the allowed outcomes.

Questions

What buyers ask next,answered plainly.

From when does the cap apply?

From the date military service began, with the excess interest forgiven and refunded and the payment reduced, once the request and orders are provided within the window.

How long is the mortgage protected from foreclosure?

During the period of service and for one year after, without a court order; the flag on the loan enforces it in the foreclosure process.

What if there are no orders?

With consent, the Department of Defense database is checked and the result recorded.
