Notices of error

How do we capture a servicing notice of error from any channel once, start the acknowledgment and response clocks on receipt, and store the response with its evidence?

Recognize the notice wherever it arrives and run the clocks from that moment. Callvu captures a borrower's written assertion of a servicing error from any channel (a letter, the portal, an email to the designated address, a complaint that qualifies), classifies the error type under the rule, sends the acknowledgment within five business days, routes the investigation to the servicing analyst with the account records in the Decision Desk, delivers the response (correction or a determination that no error occurred, with the borrower's right to the documents) within the applicable period, and stores the response and the evidence on the loan.

The problem today

The borrower's letter said 'you applied my payment wrong', and it was filed as correspondence.

Today, without Callvu

A borrower writes that a payment was misapplied, or that a fee is wrong, or that the escrow analysis is off. The letter goes to the mail room, then to a correspondence queue. Nobody recognizes it as a notice of error under Regulation X, so the acknowledgment and the response clocks run unseen. The response, when it comes, is a form letter without the documents.

Regulation X lists the error types a notice of error covers and sets the clocks: an acknowledgment within five business days, a response within 30 business days (seven for a payoff statement error, and before a foreclosure sale for certain errors), extendable by 15 days with notice. The response must either correct the error or explain why no error occurred and tell the borrower they may request the documents relied on. A notice sent to the designated address is a notice of error even if it says 'complaint'.

The recognition is the control. The clocks follow.

How it runs

From the requestto the system of record.

A borrower's written assertion arrives in any channel. Callvu classifies whether it asserts a covered servicing error and, if so, records the receipt date and opens the case with the clocks.

Borrower
Asserts the error, provides details through a link where needed, and receives the acknowledgment and the response.
Servicing analyst
Investigates with the account records and records the determination in the Decision Desk.
Compliance
Reviews responses the classification flags and sees every notice against its clock.
Callvu
Recognizes, classifies, acknowledges, assembles records, routes, delivers the response and stores.
  1. Recognize and classify

The written assertion is classified against the rule's error types (failure to accept a conforming payment, misapplication, failure to credit, fee or charge not permitted, failure to provide an accurate payoff, failure to provide loss mitigation protections, foreclosure errors, failure to transfer information on a servicing transfer, and any other covered error); the receipt date is recorded and the acknowledgment and response deadlines are set by type.

  2. Acknowledge and assemble

The acknowledgment is delivered within five business days by the consented method; the account records bearing on the asserted error (the payment history, the fee assessments, the escrow analysis, the servicing transfer records, the loss mitigation file) are assembled into the case for the analyst.

  3. Chase and verify, then decide

Where the investigation needs more from the borrower, it is requested through a link; the analyst determines in the Decision Desk whether an error occurred, and the outcome is correction (with the correction made in the servicing system) or a determination that no error occurred with the reasons, the documents relied on and the statement of the borrower's right to request them. An extension (15 business days, with notice before the original deadline) is a Decision Desk step.

  4. Respond and write back

The response is delivered within the period, the correction is posted where applicable, and the notice, the classification, the acknowledgment, the investigation, the response and the evidence are stored on the loan in the servicing system, with the dates against the clocks.

Where it ends: Every notice of error was recognized where it arrived, acknowledged within five business days, investigated with the records and answered within the period with the required content, and the response and evidence are on the loan. The Decision Trace shows the classification and the clocks; the Audit Trace shows receipt, acknowledgment, investigation and response.

Runtime enforcement

What is enforcedwhile the work runs.

The regulations preloaded in Callvu Studio and the bank's own policies, applied as steps that run, not lines in a binder. A step that breaks a rule does not run, so a completed run was compliant.

The handoff

Between the front doorand the back office.

The front door

Any channel: mail, the designated address, the portal, email, a complaint. The borrower meets the process in the acknowledgment and the response.

The back office

The analyst investigates from assembled records in the Decision Desk; compliance sees every notice against its clock.

The Decision Desk

  • The analyst records the determination in the Decision Desk with the records and only correction or no-error-with-reasons as outcomes; an extension and any flagged response go to compliance.
